Resolution Matters

Mediation

Mediation has been an important part of the litigation process in Ontario for many years and for good reason. The mediator you choose can make the difference between the resolution of a file and a costly trial with an uncertain result. Agreements are more easily reached when parties meet face to face and get a chance to explain their side of a dispute. Although a mediator has no power to make a decision for a party or decide issues, it provides a forum and process where information can be exchanged, issues set out, positions explored and evaluated and differences of opinion expressed in an atmosphere less adversarial than a trial. A mediator helps facilitate the process and keeps the parties on track and working toward an agreed resolution. Reaching settlement at the mediation stage is the cost efficient and risk reducing alternative to trial.
